What To Do If Charged With DUI?

by | Jul 8, 2021 | CRIMINAL DEFENSE, DUI |

Following July 4th holiday, many people are finding themselves charged with DUI or other such offenses in Boone, Campbell or Kenton counties.  If you were charged, the first step is to contact an experienced criminal defense and DUI defense attorney. Many police agencies had extra officers and heightened alert to drunk drivers, especially during holidays.

The attorney will research your case, discuss options, and review what viable defenses may be available.  This may include filing a Motion to Suppress either the stop, the arrest or the results of a breathalyzer.  There are many Constitutional protections which may be utilized for your benefit.  In most cases there is also a video of various portions of the arrest.  This may include traffic violations, field sobriety tests (FST), body camera, dash camera, transportation and/or reading of rights and breathalyzer machine refusal or testing.

An attorney can help guide you through the process and assure your rights are protected.  Even if you plan to enter a guilty plea, an experienced attorney will first look at the case to assure that the Commonwealth can prove the elements of the crime.  There are some cases where a guilty plea is negotiated. Your lawyer will handle those negotiations to assure you get the best deal possible.  This may include lesser charges, dismissal of other charges and/or waiving of aggravating circumstances which could affect mandatory jail time.

Your attorney can often negotiate minimal fines, minimal or no jail time, limited suspension with driving privileges and/or ignition interlock, and can direct you to evaluations
