Expungements in Kentucky must begin with a certified criminal background check which costs $42. The Administrative Office of the Courts (AOC) runs the check which then must be verified by the Kentucky State Police (KSP). Our office begins by obtaining information necessary and ordering the background check; this includes name, prior names, social security number, date of birth and address. This typically takes 1-3 months to receive the certified background check.
Once the background check is completed, our office will assist in determining what charges are eligible, review to see of others may be eligible and AOC/KSP made any errors, and then preparation of Petition to Expunge as well as Orders for the judge. In some cases and jurisdictions, a court appearance may be required for the court to determine if expungement is warranted. If the expungement is discretionary, an attorney will attend court and explain to the judge why it should be granted.
