If you have dismissals, acquittals, old cases, or even convictions in Kentucky, many cases are eligible to be expunged from your criminal record. There are no automatic expungements. Even if you went through a misdemeanor or felony diversion program, those charges remain on your record for anyone – potential employers, nosy neighbors, investigative agencies – to find and see. If looking, they can look up the charges, dates, and the allegations made against you.
If you have an acquittal, dismissal, or you have completed diversion, you are likely eligible for expungement immediately. If you have a conviction that is over 5 years old, you may also be eligible to have those cases expunged. Having practiced law in Kentucky for over 30 years, there have been many changes to the expungement statutes. Additionally, many years the law changes, often allowing for more cases to be removed from your record.
For almost all expungements, it is required to file together with the motion a criminal background check. Our office has established a policy of first ordering the background check with no charge to the client except the cost of the check (currently $42.50). The time it takes for AOC and KSP to provide the check varies widely. Originally, it took about 2-3 days, but more recently has been taking 2-4 months. Once the check is completed, we review and contact the client to determine if they wish to proceed and advise what charge or charges are eligible for expungement.
Additionally, EPO cases can generally be expunged so long as a DVO was not entered. EPO cases are not criminal, but they do still show up on a criminal background check and the case can be found if looking online, even if the EPO was dismissed by the Petitioner or by the Court.
Single misdemeanor expungement fees are generally $500. Felony charges start at $1,000 and a hybrid hourly fee is generally set for clients with multiple cases to be expunged.
