Top 5 Divorce Mistakes

What Are the Top 5 Mistakes Made During Divorce?

Having practiced divorce law in Northern Kentucky and Cincinnati for over 20 years, I have the unique perspective of spotting the mistakes made by those going through a divorce.  This is far from an exhaustive list, but here are my top 5:

1. Involving your children.  If you try to get the children to "choose sides," agree with your position or to understand the issues, you are not giving them your unconditional love.  If they believe that you can turn it on/off due to anger, their concern will extend to will Mom love me if I make her mad?  Remember, this is a separation of husband and wife and not parents and children.

2. Playing out the drama on Social Media.  This not only makes you look bad and alienates friends and family, but also becomes fodder for opposing counsel should the case proceed to litigation.  Share your concerns or frustration privately with (a) your counselor; (b) your attorney; or (c) ONE best friend.  Do not make your fight public.

3. Failing to acknowledge a bad marriage.  This is more difficult.  Often, parties wonder if separation is actually better... if the grass really is greener.  They go back and forth between separated and reconciliation.  This is difficult on both parties, the children.  If you are in a bad marriage, end it.  If the marriage is not bad and both parties are willing, seek counseling.    

4. Failing to give clear direction.  If you do not know where you are going, any road will get you there.  Map out a 6 month, 3 and 5 year plan.  Share that with your attorney and ask him/her how you can get there.  Without a plan, guidance is difficult and representation sometim-es becomes haphazard.

5. Going it alone.  Get a team, starting with an experienced family/divorce attorney.  If needed, involve a psychologist or family counselor, get a finanical advisor and surround yourself with a support staff. Spot your weaknesses and fill them with professionals.
