What is Punishment for Theft By Unlawful Taking Under?

Theft Under, often the charge for Shoplifting, is a misdemeanor in Kentucky and is for thefts which are under $500. Theft By Unlawful Taking Under $500.00 is a Class A misdemeanor. It carries up to 365 days in jail and/or a maximum fine of up to $500.00, plus court costs of approximately $140.00.  It is important to hire an attorney for this type of case. If the value of the items retrieved or stolen is over $500, the charge is Theft Over, a D felony which carries 1-5 years in prison. If it is a first offense, it is often possible to avoid jail sentence and may be possible for alternate resolution such as diversion or mediation.  These resolutions could offer the opportunity to keep the charge from your permanent record with the ability to void and/or expunge the charge and avoid conviction.  If a 2nd or subsequent offense, an attorney may help you avoid jail and/or plan a defense to the charges.
