What Is The Criminal Process For A Misdemeanor or DUI?

After an arrest in Northern Kentucky, most defendants make bail/bond.  The first appearance is called the arraignment.  You only have the right to plead guilty or not guilty at the arraignment.The court typically schedules the next hearing for a pretrial conference.  This is an opportunity for the defense and prosecutor to discuss the case and make sure all discovery is exchanged.Discovery typically includes the citation, the officer’s notes and/or worksheet and may include a video of the arrest.  An attorney may then choose to request a suppression hearing before or go straight to trial.A trial can be by the bench (judge only) or to a jury (typically 6 jurors).  If found guilty, the judge will sentence the defendant.  In Northern Kentucky, the jury recommends a sentence to the judge.
