What’s In An Estate Plan?

Each estate plan is customizable and should be tailored to fit your needs. That being said, there are some common elements found in most estate plans. They include:

A will: A document specifying how your property/assets should be divided and to whom they should be given. You can also use a will to name guardians for your minor children, when applicable.

One or more trusts: These are financial tools used to pass assets to intended beneficiaries through a third party. They often give you more control over how and when the assets are disbursed. Trusts can also help you avoid probate in some cases.

Powers of attorney: These are often split into durable power of attorney and health care power of attorney. Someone you designate as durable power of attorney can make legal decisions on your behalf if you become unable to make or communicate those decisions yourself (because of mental incapacity, for instance). Health care power of attorney is the same, but for decisions regarding your medical care.

A living will: This document outlines your wishes for end-of-life medical care in case you are unable to communicate your preferences. Do you want to be kept alive using the help of life support machines? Do you want a do-not-resuscitate order? These are just two of many examples of decisions that could arise.
