Many DUI websites can assist you in finding answers to questions, but the most often asked question is "Do I need an attorney?"  The short answer is that no one is required to have an attorney but that everyone should utilize counsel.  Even the greenest attorney can aid you in helping to get a decent deal.  An experienced attorney can do a number of things:

1. Evaluate your case and determine if there are suppression issues.
2. Help decide if your case should be taken to trial and whether a bench/judge trial or jury trial.
3. Negotiate the best plea deal possible and help you determine if it is the right thing for you.
4. Know the difference between a good, average and bad plea deal.
5. Know what things can be negotiated out and what the prosecution will demand are included in any deal.
6. Prepare for suppression hearings and/or trial.
7. Knowledge of the judge and court system to know specific tendencies of the judge handling your case.
8. Obtain all discovery and know what the prosecution may offer against you if the case proceeds.

Many people have questions about what to do if stopped for suspected DUI, whether to consent to the breathalyzer and how much is too much to drink and drive.  None of these questions have specific answers.  It is easy to say "refuse all tests" or "refuse a breathalyzer" or "don't drink and drive", but those are not realistic and not very good answers.  Many times the answer is it depends.  If you have not had anything to drink, you should usually not refuse a breathalyzer.  You can use tools to help calculate your blood alcohol level.  To say every case is different, is an understatement.  I handle 40-70 cases each year and there is something unique to virtually every single DUI case.
