Merry Christmas - Happy DUI

All too often people find themselves in unusual situations during the holidays.  Whether at an office Christmas party or at a relative, often a normally responsible adult finds that they have consumed too much alcohol then drive home.  This can be a very stressful situation, especially if you are arrested for DUI and spend the night in the local county jail. Northern Kentucky is no different than any other area of the country.  Boone, Campbell and Kenton county have police and sheriff cruisers looking for impaired drivers.  First rule, keep your holiday alcohol consumption to a 2 drink maximum.  If you are pulled over and have not consumed more than 2 drinks, be polite and follow the officer's recommendations.  If you are curious about your blood alcohol level, use the BAC calculator, the link for which is provided by clicking. Know that if you refuse the breathalyzer, urine or blood test, you will likely lose your license for 120 days, beginning at your first appearance, arraignment, in court.  If you have not had but 1 or 2 drinks, your best bet is to submit to the breathalyzer test. What is Punishment for Theft By Unlawful Taking Under?

Theft Under, often the charge for Shoplifting, is a misdemeanor in Kentucky and is for thefts which are under $500. Theft By Unlawful Taking Under $500.00 is a Class A misdemeanor. It carries up to 365 days in jail and/or a maximum fine of up to $500.00, plus court costs of approximately $140.00.  It is important to hire an attorney for this type of case. If the value of the items retrieved or stolen is over $500, the charge is Theft Over, a D felony which carries 1-5 years in prison. If it is a first offense, it is often possible to avoid jail sentence and may be possible for alternate resolution such as diversion or mediation.  These resolutions could offer the opportunity to keep the charge from your permanent record with the ability to void and/or expunge the charge and avoid conviction.  If a 2nd or subsequent offense, an attorney may help you avoid jail and/or plan a defense to the charges. Theft Charge - Should I Hire An Attorney?

If you have been charged with a crime you should hire an attorney. I know this seems overly simple, but it is the truth.  On a Shoplifting, commonly known as Theft Under (theft < $500) in Kentucky, there are many possible outcomes.  With the holidays, there is an increase in the number of shoplifting charges as well as an increase in the number of prosecutions. Theft under $500 is an A misdemeanor in Kentucky which can be punishable by up to a $500 fine and 12 months in jail.  This is serious.  The case can be dealt with anywhere from a  diversion to actual jail time.  If it is a first offense, an attorney can help you through the process and try to assure that you are eligible and entered into the diversion program.  This usually involves classes and community service, payment of a fee and then the case may be dismissed.  Once dismissed, the attorney can assist you in having the charges expunged from your record.
