What Is A "Diversion Program"?

At times, prior to trial, a defendant may be found eligible for a diversion program in Northern Kentucky. These programs are not available in all communities. Typically, they are aimed at young offenders who have no significant criminal records.If a person successfully completes the conditions of a diversion program, which may include such requirements as counseling, attendance of crime impact classes, and regular attendance at school, either no charge is filed, or the charge is dismissed. If the defendant violates the terms of the diversion program, the charges are reinstated. If the case is a felony, the defendant enters a guilty plea prior to being placed in the Diversion program.  As such, if the defendant violates the terms of the diversion, she/he may be then terminated from the diversion program and then sentenced based on the original plea.If you have questions about diversion programs or other criminal matters and wish to speak to an attorney, call Mike Bouldin at 859-581-6459.
